WHAT IS THE "NO-FAULT" LAW IN NEW YORK?

New York State abides by the “no-fault insurance” (sometimes referred to as “personal injury protection insurance” or “PIP”) laws and regulations. What that means is regardless of who was at fault for the accident, you may be entitled to benefits. In order to negotiate a possible settlement with the insurance carrier, it is required for you to meet a standard of what is known as a  “threshold of injury” that includes:

  • Death;
  • Dismemberment;
  • Significant disfigurement;
  • A fracture;
  • Loss of a fetus;
  • Permanent loss of the use of a body organ, member, function or system;
  • Permanent consequential limitation of the use of a body organ or member;
  • Significant limitation of the use of a body function or system;
  • An injury or impairment of a non-permanent nature which prevents you performing your usual and customary daily activities for not less than ninety (90) days during the one hundred and eighty days (180) immediately following the accident.
 
Seek medical attention immediately after you’ve been involved in an accident. Continue to get medical treatment until you know the full extent of all your injuries.  Sometimes it takes weeks or even months for you to know what you have injured. Do not downplay your injuries at any time.  Always be upfront and truthful with your doctors about what is bothering you and never talk to anyone who isn’t a doctor about your injuries.
