MEDICAL MALPRACTICE

Medical professionals are supposed to conduct themselves with responsibility and care when providing their services. If a physician is negligent or reckless, they may cause harm that was otherwise avoidable. When that happens, they can be held liable for legal or monetary damages. It is important to know that medical malpractice depends on the following factors:

  • The relationship exists or existed between you and the medical professional;
  • You must show that the medical professional failed to act within their scope of their employment duties;
  • You must show that you suffered a physical harm or financial loss as a result of the medical professional’s actions.
COMMON MEDICAL MALPRACTICE CLAIMS CAN INCLUDE:
  • Doctors, nurses and health care staff;
  • Surgery and routine medical procedures/examinations;
  • Injury during child birth;
  • Injuries such as brain damage, erbs palsy and cerebral palsy, quadriplegia, paraplegia and other spinal injuries;
  • Nerve damage;
  • Loss of sight, loss of hearing;
  • Wrong medical prescription;
  • Failure to diagnose or misdiagnosis, or failing to monitor a patient;
